These Terms and Conditions (“Agreement”) govern the use of services provided by Insta Perf (“Company,” “we,” “us,” or “our”) to the client (“Client,” “you,” or “your”). By purchasing, accessing, or using any Insta Perf services, you agree to be bound by these Terms.
1. Scope of Services
Insta Perf provides business growth and automation services primarily for construction and service-based businesses, including but not limited to:
Search Engine Optimization (SEO)
Google Maps / Local SEO optimization
Automation systems and workflows
AI Receptionist and automated communication systems
Outbound campaigns for predictable high-ticket project sourcing
CRM, pipeline tracking, and analytics
ROI, performance, and financial visibility reporting
Specific deliverables, timelines, and pricing are defined in your individual service agreement, proposal, or invoice.
2. No Guarantee of Results
While Insta Perf applies proven strategies, systems, and best practices, we do not guarantee specific outcomes, including but not limited to:
Revenue amounts
Number of leads or projects
Rankings on Google or Google Maps
Conversion rates or deal size
Results depend on multiple factors beyond our control, including market conditions, competition, client responsiveness, budget, and execution consistency.
3. Client Responsibilities
To ensure successful execution, the Client agrees to:
Provide accurate and complete business information
Respond to requests for approvals, access, and assets in a timely manner
Grant necessary access to platforms (Google Business Profile, website, CRM, etc.)
Maintain ethical and legal business practices
Comply with all applicable local, state, and federal laws
Delays or failures caused by missing information or lack of cooperation may impact results and timelines.
4. Automated Messages, Notifications & Communication Consent
By providing your contact information, you consent to receive calls and text messages related to:
✔ SMS/text message
✔ Customer support
✔ Promotions (if opted in)
✔ Email
✔ Automated voice alerts
✔ Automated pipeline notifications
✔ Appointment reminders
You may opt out at any time by replying STOP to SMS messages or using the unsubscribe link in emails.
Consent to automated messages is not a condition of purchase and complies with TCPA, FCC, and GoHighLevel standards.
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
a. You can cancel the SMS service at any time. Simply text “STOP” to the shortcode. Upon sending “STOP,” we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.
b. If you experience issues with the messaging program, reply with the keyword HELP for more assistance, or reach out directly to [email protected].
Carriers are not liable for delayed or undelivered messages.
c. As always, message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.

5. Payments & Fees
All fees are due as outlined in the agreed proposal or invoice.
Setup fees, monthly retainers, and campaign costs are non-refundable unless stated otherwise in writing.
Late payments may result in paused services.
Subscription services renew automatically unless canceled per the agreed notice period.
Failure to pay does not release the Client from contractual obligations.
6. Intellectual Property
All systems, workflows, scripts, templates, strategies, and automations developed by Insta Perf remain our intellectual property unless otherwise stated.
The Client receives a non-transferable license to use deliverables for their own business only.
Resale, duplication, or redistribution without written consent is prohibited.
7. AI & Automation Disclaimer
Insta Perf may deploy AI-driven systems (including AI receptionists and automated messaging). The Client acknowledges:
AI responses are automated and may not be perfect
Final responsibility for customer communication remains with the Client
Insta Perf is not liable for miscommunication caused by inaccurate data provided by the Client
8. Outbound Campaign Compliance
For outbound and lead-sourcing campaigns:
Client confirms they have the legal right to contact prospects
Client agrees to comply with CAN-SPAM, TCPA, GDPR, and other applicable regulations
Insta Perf is not responsible for penalties arising from improper usage or misuse of outbound systems
9. Analytics & Financial Reporting
Analytics and ROI reports are provided for decision-making support only.
They should not be considered legal, tax, or financial advice.
The Client is responsible for verifying numbers with their accountant, CPA, or financial advisor.
10. Limitation of Liability
To the maximum extent permitted by law:
Insta Perf shall not be liable for indirect, incidental, or consequential damages
Our total liability shall not exceed the fees paid by the Client in the preceding 30 days
We are not responsible for platform outages (Google, Meta, CRM tools, hosting providers, etc.)
11. Termination
Either party may terminate services per the terms outlined in the service agreement. Upon termination:
Outstanding balances remain due
Access to systems may be revoked
No refunds will be issued for completed or in-progress work unless explicitly stated
12. Confidentiality
Both parties agree to keep confidential information private, including business data, strategies, pricing, and proprietary systems.
13. Governing Law
This Agreement shall be governed and interpreted in accordance with the laws of the State of Iowa, without regard to conflict of law principles.
14. Modifications
Insta Perf reserves the right to update these Terms at any time. Continued use of services constitutes acceptance of the updated Terms.
